General Release and Limitation of Liability

By submitting the Material Pickup Request Form, the User ("Owner") agrees to release Abrasive Removal Services ("Contractor"), its employees, agents, successors, and assigns from any and all liability, claims, damages, or causes of action that may arise out of or relate to the services provided, including but not limited to:

  • Collection, transportation, storage, and disposal of materials.
  • Use of the Contractor's web application or related services.
  • The Contractor expressly denies any liability for damages to property, injuries, or environmental consequences resulting from the handling, storage, or disposal of materials as requested by the Owner.
Hazardous Materials

The Owner acknowledges that any material designated as hazardous must be properly disclosed, including submission of relevant laboratory reports or documentation. The Contractor assumes no responsibility for misclassified materials or omissions made by the Owner.

Owner Responsibilities

The Owner agrees to:

  • Provide accurate and complete information in the Material Pickup Request Form.
  • Ensure that all materials are properly contained and prepared for pickup as per the specifications in the form.
  • Accept full responsibility for any additional costs, liabilities, or legal actions arising from inaccuracies in the provided information or failure to comply with applicable regulations.
Hauler Terms and Liability

Any individual or entity ("Hauler") who accepts or is assigned a Material Pickup Request through the Abrasive Removal Services platform agrees to the following terms in full. These terms are binding and apply to all services performed by the Hauler in relation to material pickup, transportation, and disposal:

  • The Hauler assumes full and sole responsibility for the safe and lawful pickup, handling, transportation, and disposal of all materials collected through the Contractor’s platform.
  • The Hauler agrees to comply with all local, state, and federal laws, regulations, and ordinances regarding the transportation and disposal of waste or materials, including but not limited to environmental regulations, DOT compliance, and hazardous materials handling.
  • The Contractor is not responsible for verifying the qualifications, licensing, insurance, or legal compliance of any Hauler. It is the Hauler's sole responsibility to maintain all necessary permits and documentation required to perform hauling services.
  • The Hauler acknowledges and agrees that any liability, penalty, fine, environmental damage, property damage, personal injury, or legal claim arising out of or related to their actions or omissions is the sole responsibility of the Hauler and not of the Contractor.
  • If the Hauler handles hazardous materials—whether properly or improperly disclosed—it remains their sole duty to ensure lawful and compliant handling, and they agree to release and indemnify the Contractor from any and all claims, actions, fines, or damages resulting from such materials.
  • The Hauler agrees to indemnify, defend, and hold harmless the Contractor from and against any claims, liabilities, damages, losses, and expenses, including attorney’s fees and court costs, arising out of or resulting from the Hauler’s performance, misconduct, negligence, or failure to comply with applicable laws.

By using the Contractor's platform or accepting a Material Pickup Request, the Hauler acknowledges and accepts these terms in their entirety.

Indemnification

The Owner agrees to indemnify and hold harmless the Contractor from and against any and all claims, damages, losses, and expenses, including but not limited to attorney's fees, arising out of or resulting from:

  • The Owner's failure to comply with applicable laws or regulations.
  • Third-party claims related to the materials handled as part of this service request.
No Guarantee of Acceptance

Submission of the Material Pickup Request Form does not guarantee acceptance or execution of services. The Contractor reserves the right to reject any request at its sole discretion.

Use of Web Application

The Contractor makes no warranties, expressed or implied, regarding the functionality, security, or availability of the web application used to submit service requests. The Owner assumes all risks associated with the use of the application.

Binding Agreement

These Terms and Conditions constitute the entire agreement between the Owner and Contractor regarding the requested services. This agreement is binding upon the parties and their respective heirs, executors, administrators, personal representatives, successors, and assigns.

Modifications

The Contractor reserves the right to modify these Terms and Conditions at any time. Continued use of the web application or submission of service requests constitutes acceptance of any such modifications.
